TRUST LAND ACQUISITIONS
As a legacy of the General Allotment Act, numerous Indian reservations are “checkerboarded,” whereby parcels of reservation lands lost trust status, were transferred into fee simple ownership, and often conveyed to non-Indian interests. Many tribes are now involved in long-term efforts to re-consolidate their lands; these efforts typically include acquiring fee lands and applying to the Bureau of Indian Affairs for the United States to accept these lands in trust status for the beneficial interest of the applicant tribe. ABWW has experience preparing fee-to-trust applications for lands situated within or outside of reservation boundaries, coordinating with the BIA throughout the application review process, and, when necessary, advocating for tribes in the agency trust-acquisition appeals process.
