EMPLOYMENT AND LABOR
The firm has substantial experience in all phases of employment relations and personnel work. The firm has developed expertise in all aspects of the law pertaining to human resources work: development and drafting of personnel policies and procedures; preparation of employment contracts; protection of proprietary and confidential information; ongoing consultation to avoid, or at least minimize risks of employment claims; representation in administrative proceedings (federal and state labor departments, Equal Employment Opportunity Commission (and similar state agencies)); and when necessary, representation in tribal, federal and state courts (including courts of appeal).
The firm counsels clients throughout the United States on wage and hour matters (overtime, compensation, etc.), restructuring and reorganizations, compensation and bonus plans, benefits, implementation of personnel policies, promotion of Indian preference, termination of employment, and employee discipline, among other things. Since the firm’s clients are scattered throughout the United States and operate both on- and off-reservation, advice is tailored to address where applicable, tribal law, federal law and regulations, and state laws that may apply to operations of tribal organizations. The firm assists its tribal clients in developing employment relationships which are fair and respectful, which preserve tribal sovereignty and discretion, which minimize the need for legal monitoring, and which reduce the risk of legal claims.
